Terms of Service

These Terms of Service (“Terms”) govern your use of the Chaki platform and services. By accessing or using Chaki, you agree to be bound by these Terms.

Acceptance of Terms

By creating an account or using any part of the Chaki platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use our services.

Service Description

Chaki is a managed e-learning platform designed for lecturers at Kenyan universities and TVETs. We provide course content digitization, student enrollment management, assignment handling, grade computation, attendance tracking, and communication tools.

User Accounts

When creating an account, you agree to:

  • Provide accurate, current, and complete information during registration.
  • Keep your login credentials secure and confidential.
  • Accept responsibility for all activity that occurs under your account.
  • Notify us immediately of any unauthorized use of your account.

Content Ownership

You retain full ownership of all content you upload to Chaki, including course materials, notes, assignments, and any other intellectual property. By using our platform, you grant Chaki a limited license to host, display, and deliver your content to your enrolled students. You may export or delete your content at any time.

Payment Terms

  • Billing is processed via M-Pesa at the start of each billing cycle.
  • Institutional billing is available via Local Purchase Orders (LPOs) and institutional payment systems.
  • Prices may change with 30 days' prior notice via email or SMS.
  • Failure to pay may result in service suspension after a 7-day grace period.

Acceptable Use

You agree not to:

  • Upload illegal, harmful, or infringing content to the platform.
  • Misuse the platform in any way that disrupts service for other users.
  • Attempt unauthorized access to other accounts, systems, or data.
  • Use the platform for any purpose other than legitimate educational activities.

Limitation of Liability

To the maximum extent permitted by law, Chaki shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or interruption of service. Our total liability for any claim shall not exceed the amount paid by you in the twelve months preceding the claim.

Termination

Either party may terminate this agreement at any time. Upon termination, you will have 30 days to export your data. After this period, we may delete your content and account data. We reserve the right to suspend or terminate accounts that violate these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising from these Terms or your use of the platform shall be resolved in the courts of Nairobi, Kenya.

Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email or SMS. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
